Banktopus Terms of Service

These Terms of Service ("Terms") govern your use of Banktopus ("we," "us," or "our") and our services. By accessing or using our website and services, you agree to these Terms.
1. Services Provided
Banktopus helps businesses apply for bank accounts by streamlining the application process and leveraging insider expertise to improve approval rates.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use our services.
3. Use of Services
You agree to use our services in compliance with all applicable laws and regulations. You are solely responsible for the accuracy of the information you provide.
4. Fees & Payment
4.1 Current Rates
All fees (upfront, success, late interest) are those published on banktopus.com when you submit. Changes apply only to new submissions.
4.2 Late Interest
2% per month, compounded monthly (Month 2 balance = Month 1 balance × 1.02).
4.3 Third-Party Fees
Any bank/fintech onboarding fees are separate—you pay them directly.
5. Refund Policy
5.1 No-Bank-Acceptance Refund
If we determine no bank will accept your docs, we'll initiate your $120 refund within 2 business days.
6. Success Fee
6.1 Risk Tier-Based
Determined by your final risk tier (Medium/High/Ultra), based on each provider's internal matrix and document requests.
6.2 No Additional Approval
We'll bill you the fee corresponding to that final tier as published at the time of success—no additional approval step.
7. Data Use & Retention
7.1 Encrypted Storage
Encrypted storage "at rest" indefinitely until you request deletion.
7.2 Right to Deletion
You can request full deletion anytime; we'll complete it in ≤ 5 business days.
7.3 Anonymized Data
We may anonymize & aggregate data to improve our LLM models—no personal/company identifiers.
7.4 Authorized Sharing Only
We only share your documents with the banks/fintechs published on banktopus.com when you submit.
8. Disclaimers & Limitation of Liability
8.1 No Control Over Bank Decisions
We don't control bank decisions or timelines.
8.2 Liability Cap
Our maximum liability is the total fees you've paid us.
8.3 No Indirect Losses
We're not liable for indirect, incidental, or consequential losses.
9. Indemnification
You agree to defend, indemnify, and hold us harmless against claims arising from your false/misleading info or prohibited use.
10. Termination & Survival
10.1 Suspension or Termination
We may suspend/terminate for TOS breaches; you still owe any accrued fees.
10.2 Survival of Clauses
Clauses 7 (Data), 8 (Liability), and 9 (Indemnity) survive termination.
11. Dispute Resolution & Governing Law
11.1 Mediation
Good-faith mediation in Dubai within 30 days of a written dispute notice.
11.2 Arbitration
If unresolved, binding arbitration under DIAC rules, seat in Dubai.
11.3 Governing Law
UAE law (Dubai) governs.
12. Changes to Terms
12.1 Lock-In at Checkout
At checkout, you lock in the "Last updated" version you saw.
12.2 Future TOS Changes
Future TOS changes apply only to new applicants; we'll publish a new "Last updated" date on the site.
